A federal judge ruled today that Disney, Warner Bros., Discovery, and Fox’s major foray into sports streaming appears to be headed for trial in October 2025 unless someone steps up to strike a settlement.Currently, ESPN and Hulu owners Disney, Max-owner WBD, and Fox will face an October 6 commencing trial next year in Judge Garnett’s NYC courtroom after blowing beyond Venu’s scheduled August launch date due to their failure to dismiss Fubo TV’s February filed antitrust suit. Judge Garnett’s July shocker against them approving Fubo’s request was appealed to the Second Circuit by Venu’s trio of investors, who had collectively spent over $50 million to prepare the now-stunted service to launch, with nothing on the field or court yet.a preliminary injunction request. In a brief submitted in September, the three outlined their challenges to Garnett’s decision. The Pete Distad-led Venu has now staked a lot of money on pulling off a Hail Mary to reverse Judge Garnett’s August judgement, with a hearing in the Court of Appeal set for January 6. It’s a significant wager that won’t halt the antitrust trial in October. With either a huge win or the lifting of the injunction and Venu’s reopening, it’s a big wager. It’s either a huge victory or a likely deadly defeat, with Venu as the outcMaking public what she said in court on December 13 to attorneys and executives representing the sluggish media behemoths and startup Fubo TV.
